Where to file

San Diego County splits family law between a central and a north county courthouse:

  • San Diego Central Courthouse 1100 Union Street, San Diego 92101. Family law for the central, south, and east districts. Central
  • North County Regional Center 325 South Melrose Drive, Vista 92081. Family law for the northern districts (Carlsbad, Encinitas, Oceanside, Vista, Escondido, San Marcos). North

Where you file depends on your residence. The court's website has a district lookup tool. Filing in the wrong courthouse will result in a transfer and a delay.

Filing fees

Standard statewide rates apply: approximately $435 to $450 for petition and response. Fee waivers (FW-001) are processed at the filing window.

Self-Help

San Diego's Self-Help Center, known as the Family Law Facilitator's Office, operates at both courthouses with similar offerings:

  • Walk-in help for forms and procedure.
  • Group workshops on common procedures.
  • The Family Law Facilitator specifically for child support, spousal support, and parentage.
  • Online self-help videos walking through SD-specific procedures.

The court partners with the San Diego Volunteer Lawyer Program for additional pro bono and reduced-fee services.

Local rules and practice

  • Direct calendar. San Diego uses direct-calendar judges — same judge throughout the case.
  • Family Court Services mediation. San Diego requires FCS mediation before any contested custody hearing. SD mediations are non-confidential — mediators may make recommendations.
  • Status conferences. San Diego routinely sets status conferences early in cases to push them toward resolution.
  • E-filing. Required for represented parties in family law cases.

Cost of representation

San Diego family law rates typically run $250 to $550 per hour, slightly below LA averages. Concentrations of firms in downtown San Diego, La Jolla, and Carlsbad. La Jolla and downtown firms tend to run on the higher end.

For low-income parties, Legal Aid Society of San Diego and the San Diego Volunteer Lawyer Program offer family law help on a needs basis.
